comply with the Plastic Waste Management Rules, 2016 or face action / Penalty as per the provision of the Plastic Waste Management Rules 2016
Plastic Waste Management Rules, 2016 have been notified by the Ministry of Environment, Forests and Climate Change, Government of India, in supersession of the Plastic Waste (Management and Handling) Rules, 2011, except as respects things done or omitted to be done before such supersession, and are applicable from the date of Gazette Notification on dated 18.03.2016. In the Rules, responsibilities of all the stakeholders including plastic bag/ Multilayered packing / Compostable plastic manufacturers, importers, brand owners, stockiest, distributors, retailers, vendors, public in general, waste generators, local bodies, gram panchayat, state pollution control boards and urban development department are given in detail.
Hon’ble NGT in its orders dated August 10, 2017 in the OA No. 281 of 2016 and OA No. 4 of 2017 has ordered complete prohibition on use of plastic carry bags, made of plastic less than 50 microns and are non-compostable in entire NCT Delhi, for any purpose whatsoever. If any person is found in possession or uses such plastic shall be liable to pay Environmental compensation of Rs. 5000 per default.
